RCI Timeshare Weeks Program Sued In Class Action Filing

Our Comments: Although the sales agents make is sound so simple to trade your timeshare unit for another one, you soon learn that it's not the case. There may be more to it than you first thought (why does this not surprise us in the least bit?). Green Welling has started a class action suit against RCI weeks program alleging that RCI rents out the most desirable vacation weeks instead of having them available for trade:

"Green Welling files a nationwide class action in New Jersey on behalf of RCI Weeks Program members. Through its Weeks Program, RCI offers its members the option of depositing their vacation week in a spacebank to exchange it for a comparable week from the spacebank. RCI states that the vacation weeks deposited into the spacebank are maintained in the spacebank for exchanges. Plaintiff alleges that RCI actually rents out the most desirable and highly demanded vacation weeks from the spacebank, thus depleting the most desirable options available to Weeks Program members who seek exchanges. Plaintiff seeks an order enjoining RCI from continuing this unlawful practice and an order requiring disgorgement of all profits RCI received in connection with renting out vacation weeks deposited for exchange in the exchange spacebank, in addition to other monetary relief.

    I attempted to make a trade with a search request for 2 years in advance of the vacation. After many discussions with RCI they told me the week I was attempting to trade did not have sufficient trading power. The week being used for the trade was a 2 Bedroom unit at a Gold Crown Resort. I also had banked 4 weeks from other resorts.

    From Leon in Charlotte NC. I have been greatly disappointed in my RCI weeks vacation. I was promised that we would be able to take vacation throughout the world, and we can't even get a vacation anywhere. I intend to pursue legal actions if takes it. I want my money back. I understand a little about legal matthers, and I'm sure RCI is committing fraud in their sells practices. Let's work together to see that others are not taken by this.

    RCI has another company called Vacation Village. They rent out weeks that RCI members should hacve access to but do not.

    Many of the people I spoke with at various resorts state that trades are seldom if ever available even with a lot of flexibility.

    RCI is ripping us off. Both weeks and points are affecte.I am contacting the state attorney general and consumer fraud bureau. I am sick of RCi and their tactics.

    RCI is ripping ioff it's members both weeks & points. Very few choices are available because they market the free timeshares through other subsuidiaris like Vacation Village. Notify you state consumer fraud bureau and your attorney general & hopefully they will set thius right.

    To start a class action suit....contact the Attorney General; of Your State, City and County with a letter of complaint and reference the New Jersey Suit. That will get things rolling.


    Also disgusted in VA....

    I made an attempt to trade for an international resort. I gave the options of up to a two year time frame to work with, several dates and several locations. RCI claimed there was no availability. I was sure there was something wrong and now it sounds like there could be.

    I am a RCI weeks member and this is what I know:

    According to the settlement, RCI suppose to change its ways of doing business and that its rentals will not impact the RCI weeks inventory for member's use. I am wondering how they are going to accomplish that if I know that RCI has business contracts with people to rent out its last minute inventory. Below is the company that has been listing and selling RCI last minute inventories online and on ebay for years now.

    The owner of this company has personally confirmed to me that he has a business contract with RCI to sell excess inventory. Look at what he sells, they are all great resorts that you can hardly find on RCI website. Shouldn't these last minute inventories be a RCI member benefit as well becasue one of the benefits that RCI advertise is "Last Call?"

    So I think this is something that should be put into consideration. These separate RCI business contracts to sells excess inventories should be stopped as well. If you agree with me, and you are a RCI weeks member, then you need to write to the attorney to object to the settlement by April 6, 2009. Here is the link for the information:

    There are people up in Canada that havae been affected by RCI lack of weeks availability. We are so fed up we just want out!

    In South Africa there too is a lack of accommodation as RCI rents out banked weeks denying the member the right to use weeks within the system. There are many complaints listed on South African complaints websites eg www.hellopeter.com RCI members on the other hand are denied the right to rent out weeks through an exchange. RCI members in South Africa have been doing this for many years with the full knowledge of RCI. RCI started cancelling RCI memberships where such members rented out weeks. In cancelling the memberships RCI has also retained the spacebanked weeks now deemed forfeited as far as RCI is concerned. As a result hereof, two RCI members in South Africa instituted legal action against RCI in the High Court to have the cancellations of their RCI memberships set aside and declared uinlawful. In the legal proceedings, the two applicants were in terms of a court order required to pay for certain of RCI's legal fees. These fees were not paid and RCI proceeded to obtain an attachment against the applicants' movable assets. As part of the attachment, the Sheriff of the Court attached four Rottweiller dogs,who in fact do not belong to the applicants - three of which are nine years and older and diagnosed with cancer.One of the dogs requires to be euthanased due to the extent of the cancer and pain that the animal is causing. Congratulations to RCI in taking their war not only against RCI members but now also to domesticated pets. Lets all hope that justice in the end will prevail.

    I am also a long-time member of RCI and each time I deal with them since 1997, RCI is unable to deliver that I ended up renting an accommodation privately. The worse part is that RCI's inability to deliver causes my weeks to reach its expiration. This system is a BIG scam.
